Rebecca Hume handles international judgment enforcement, fraud and asset tracing, insolvency litigation, complex commercial disputes with particular emphasis on private equity, hedge funds, and joint venture and partnership disputes.

Her practice covers both offshore and onshore regions, and she represents shareholders and other stakeholders in both solvent and insolvent liquidations. She also regularly represents clients in high-stakes shareholder disputes including dissenters' rights matters.

Ms. Hume represents interests in the Cayman Islands and the UK in disputes related to the financial services and insurance industries, among others. Working frequently with onshore co-counsel, particularly in the United States, Ms. Hume strategizes to find creative, multijurisdictional solutions to recover assets for clients who include trustees, investors, creditors, managers, and independent directors of distressed investment funds. She also advocates for financial institutions and governments.

  • Representation of the liquidating trustee of a brokerage firm relating to a Ponzi scheme involving US $5 billion+ in investments. Acted as special counsel focused on clawback and director and officer claims of US $300 million+ against debtors with assets located in onshore and offshore jurisdictions.
  • Representation of a London-based investment firm in the contested restructuring of a European drilling company, involving dissenting investors who disputed the fair value of the shares under Section 238 of the Cayman Companies Law. The buyout of the firm’s investment shares totaled approximately US $500 million.
  • Representation of the Bahamian receiver of UK-based insurance conglomerate in relation to issues over the validity of a security in the Cayman Islands.
  • Representation of a beneficiary of a revocable offshore trust in Cayman Islands proceedings brought by the professional trustee in respect of parallel onshore (U.S.) proceedings.
  • Representation of a government in enforcing judgments of US $120 million+ against assets and defendants in multiple jurisdictions in the U.S., the Caribbean, and Asia.
  • Advice to an Asian venture capital firm, in providing advice relating to inspector and liquidator appointments under Cayman law with respect to the takeover of a Chinese company.
  • Representation of a major stakeholder relating to the liquidation of prominent Cayman-registration hedge fund valued at US $500 million+.
  • Representation of the liquidator of a corporate trustee relating to litigation commenced in the Cayman Islands involving two Cayman Islands trusts and allegations of fraud against one of the beneficiaries.
  • Representation of a merchant bank in regard to their investment in a high-worth fund following the collapse of Bear Stearns.
  • Representation of several limited partners in a shareholder dispute regarding a multimillion-dollar fund primarily invested in the Russian retail sector.
  • Acting as expert on matters of Cayman law in a multimillion-dollar professional negligence action commenced in the U.S. arising out of Madoff.
